Zoom Media Privacy Policy

This Privacy Policy (the “Policy”) describes the privacy practices for the ZoomMedia.com website (the “Site”). This Policy also applies to:

  1. Personal Information collected through offline interactions with you such as when you call us, apply for a job or when you provide Personal Information to one of our representatives such as at a conference (collectively referred to as “Interactions”); and
  2. other websites, web or mobile applications the Zoom Media Insight Community and other products or services that are offered and operated by or for Zoom Media and/or its parents, subsidiaries, and affiliated entities (collectively, “Zoom Media,” “we,” or “us”) if such product or service displays this notice

(collectively, and together with the Site, the “Services”). Other components of the Services may maintain separate Privacy Policies.

BY ACCESSING OR USING THE SERVICES, YOU ARE ACCEPTING AND CONSENTING TO THE PRACTICES DESCRIBED IN THIS POLICY, INCLUDING CONSENTING TO THE POSSIBLE TRANSFER OF YOUR PERSONAL INFORMATION OUTSIDE OF YOUR PROVINCE, STATE OR COUNTRY OF RESIDENCE AND ACROSS INTERNATIONAL BORDERS. Please read this Policy carefully to understand our data collection and privacy practices. If you do not agree with this Policy, which may be updated and modified from time to time, your only option would be to leave this Site or not access or use the Services, as the case may be, and not provide any Personal Information to us.

The Services may contain links to other websites or platforms that are not owned or operated by Zoom Media and are only provided for your convenience and information. Your use of these links will be at your own risk. These sites and platforms may have their own privacy policies and practices. We are not responsible for the privacy practices or the content of those sites and platforms.

1.            WHAT INFORMATION DO WE COLLECT? +

In this Policy, the term “Personal Information” means information in any form as interpreted by applicable privacy laws about an identified individual or an individual whose identity may be inferred or determined from such information. Please note that you are not required to provide Personal Information to simply surf our Site. Only aggregated or anonymized information using cookies or other tracking technologies is provided to us (only if your browser or device has been set to allow such collection).

For the purpose of this Policy, Personal Information includes, without limitation your name, address(es), personal telephone number(s), email address(es), date of birth, any unique identification number we assign to you (individually a “UID” and collectively “UIDs”)”), and any reward, loyalty, or incentive account numbers and Sensitive Data. “Sensitive Data” means Personal Information that discloses or reveals health and medical conditions, sexual orientation or sexual life, political opinions/views, race/ethnic origin, religious and philosophical beliefs and trade-union membership. Sensitive Data may be used to target survey opportunities to you. Sensitive Data would only be required in exceptional circumstances, and in those circumstances, we will obtain your express consent.

We may collect and process both Personal Information and non-personal identifiable information (“Non-PI”) about you, including the following:

  • Information, including Personal Information, that you choose to provide when you submit information through the Services or register with a Zoom Media Insight Community (“Community”), such as your first name, last name, email, mobile number, profile photo, age, gender, and other demographic information. If you choose to log in, create an account, or otherwise connect with the Services through a third-party account (such as Facebook, LinkedIn, Google+, Twitter, or other services), you are asking and authorizing that third-party service to send us certain information from your profile, as it may be updated from time to time, and you authorize us to collect, store, and use all of the information that is or may become available to us through the third-party service’s interface.
  • Information, including Personal Information, that you choose to provide to us via contact forms generated by a third-party social media platform (e.g., LinkedIn), such as your first name, last name, email, mobile number and other information. For example, you may be asked to submit Personal Information through a lead generation form (automatically populated contact form) (“Form”) generated by LinkedIn. If you choose to voluntarily provide such Personal Information, you are asking and authorizing LinkedIn to send us the information in the Form and you authorize us to collect, store, and use such information for the purposes set out in this Policy and if applicable, in the applicable Form.
  • Information, including Personal Information, that you provide while using the Services. If you participate in a Community, apply for a job with us, complete a survey, enter a contest, or participate in other such activities on the Services, you may be asked to provide additional information to participate in such activities or receive such services (e.g., your mailing address if you enter a contest or your c.v. if you apply for a job). If you contact us, such as to report a problem with our Services, we may ask you to provide additional information to allow us to investigate the reported problem. Similarly, we may keep a record of other communications that you direct to us.
  • Information regarding transactions that you carry out through our Services, including details relating to any rewards or incentives that we may provide for your participation in a Community.
  • Certain features on the Services may allow you to submit content that is designed to be visible to other users or Community members, such as comments, recommendations, reviews, and ratings. Any information that you disclose in these submissions becomes public, along with your screen name or ID, any image or photo, or other information that you have made available. We are not responsible for the information you choose to submit through these features.
  • If you use one of our location-enabled services, we will need to collect and process information about your location, which is generally the latitude and longitude of your mobile device (obtained through the unique identifier for your device) at the times you use the app. In order to support your transactions, we will associate location data with your device ID and your account information. We will also use this information to improve our service. You can turn off the location services in the app if you no longer wish to use the location-enabled services.
  • Information regarding your visits to and interaction with our Services, which we collect automatically. This information includes, without limitation, information about (i) your device or computer and its capabilities, including the operating system, the applications or programs on your device or computer, IP address, device carrier, device type, time zone, network status, browser type, browser identifier, unique device identification number, carrier user ID (a number uniquely allocated to you by your network provider), media access control address, international mobile equipment identity, locale and other information that alone or in combination may be used to uniquely identify your device or computer; and (ii) your activities in connection with the Services and Community, including, without limitation, survey data and responses, and reward, incentive, and/or sweepstakes information. We may also use various methods and technologies to collect information so that we can learn about how you use our Services, including cookies and web beacons, as further described in this Policy, and web logging, which allows us to collect the standard information that your web browser sends to every web site you visit, such as your IP address, browser type and language, and the site you came from, as well as the pages you visit and the links you click while using the Services.

Other Personal Information may be collected or obtained: (a) to protect our interests; (b) to enforce our policies; (c) to comply with legal and regulatory requirements; and (d) as otherwise permitted pursuant to applicable laws or as otherwise authorized by you.

2.            HOW DO WE USE THE INFORMATION THAT WE COLLECT? +

General Purposes

Our primary goal in collecting Personal Information is to communicate with you as follows: (i) to communicate with you regarding your membership in a Community; (ii) to communicate with you regarding your participation in a survey(s); (iii) to tailor survey opportunities and advertisements to you; (iv) to send you notifications of survey opportunities; (v) to respond to your inquiries, requests and complaints; (vi) to administer and manage Zoom Media’s reward and incentive programs (including our sampling program) and fulfill your requests for rewards and incentives; (vii) to facilitate your entry into Zoom Media’s sweepstakes and promotions and communicate with you regarding such entries; (viii) to update Zoom Media’s records; (ix) to comply with any data suppression obligations or requirements; (x) for fraud detection and/or prevention purposes; (xi) to comply with any and all legal obligations, including, without limitation, tax obligations; and (xii) as otherwise permitted pursuant to this Policy or as otherwise authorized by you.

We also use your information to improve your experience on our Services, to customize certain features of the Services, for instance, to tailor your experience to the type of device you are using to access the Services and deliver content in the most effective manner.

Access to your Personal Information by our employees is strictly limited to those who need to access it to perform their roles. For example, those within Zoom Media who can access your Personal Information are the human resources department if you have applied for a position with us, the information technology department if there are technical issues with respect to the Services, the customer service department to address any inquiries you may have and the marketing department to inform you of upcoming campaigns or to send you the newsletters to which you have subscribed.

Lead Generation Tools

Without limiting the generality of the above in this Section 2, like many other companies, we use lead generation tools offered by social media platforms (such as LinkedIn) to collect information for our advertising campaign and business development efforts. The lead generation forms (“Lead Gen Form”) generated by such tools create easy-to-fill forms which capture information from members of the applicable social media platform if they choose to provide such information. Such Personal Information will not be shared outside of Zoom Media except as set out in Section 3 below or if required by applicable laws.

We collect Personal Information as well as Non-PI through the Lead Gen Forms and use the information for the purposes set out below (in addition to the general purposes set out above as well as any other purpose(s) which may be described in the applicable Lead Gen Form):

  • Non-PI: Non-PI, such as statistics, is used to analyse the performance of our advertising campaigns on the applicable social media platform (e.g. LinkedIn); and
  • Personal information: For the Lead Gen Forms, we do not collect Personal Information other than in the section where you are asked to enter your Personal Information for completing the applicable Lead Gen Form (e.g. email address). Such information is then used to send you our campaign ads through the applicable social media platform. To opt out of ads featured through a social media platform, please consult the applicable social media platform’s settings and privacy policy. Where promotional emails are sent directly by us, you may opt out of receiving promotional emails from us by contacting us or by following the “unsubscribe” instructions in any promotional email you receive from us. Please note, however, that we may still send you non-promotional, transactional or service-related emails about your relationship with us.

3.            HOW DO WE SHARE THE INFORMATION THAT WE COLLECT? +

Zoom Media will disclose Personal Information and other information collected through the Services to third parties as follows:

(a)      With your consent, other than your consent to the processing and sharing described in this Policy and specifically, this section.

(b)      Pursuant to applicable law or in response to a subpoena or an order of a court or government agency.

(c)      To establish, exercise, or defend legal claims of an individual or Zoom Media, including in order to protect the safety of an individual or to protect Zoom Media’s rights and/or property.

(d)      To a parent, subsidiary, or affiliate of Zoom Media: (i) in the event of a reorganization, restructuring, or a change of ownership or control, including, without limitation, a merger or an acquisition of any or all of Zoom Media’s business assets; (ii) for market research related uses including, without limitation, modeling, validation, fraud detection and/or prevention, data append, database segmentation, and reward, incentive, or sweepstakes redemption, fulfillment, and/or entry in connection with your participation in or completion of a survey; or (iii) for use and processing in accordance with this Policy or as authorized by you.

(e)      To authorized agents and/or subcontractors of Zoom Media who are providing services, including, without limitation, services related to a Community, services related to a lead generation service, data append services, data validation services, campaign attribution services, sample fulfilment services, recruitment services, fraud detection and/or prevention services, database-matching services, coding services, data segmentation services, and reward, incentive, and sweepstakes related services.

(f)      Zoom Media will provide survey data and responses to partners and customers of Zoom Media, with no Personal Information disclosed by Zoom Media, other than UID. If you voluntarily disclose Personal Information in connection with your survey responses, however, and Zoom Media collects the survey responses, Zoom Media will transfer the survey responses, UID and the voluntarily disclosed Personal Information to Zoom Media’s partners and customers. In addition, Zoom Media may share geographic and/or demographic data that Zoom Media collects from you during enrollment or through certain profile questions Zoom Media may ask you. Such data may be shared with third parties in single summary form (i.e. individual respondent level) or aggregate summary form (i.e. a group of respondents).

(g)      As otherwise permitted pursuant to this Policy.

Additionally, UIDs and information collected by automated means are provided to third parties, including, without limitation, clients, partners, agents and/or vendor for several purposes including, without limitation, identifying respondents for re-contact surveys or communications, fraud detection and/or prevention, database matching, data validation, data append, coding, data segmentation, and reward, incentive, sweepstakes or promotion related services and/or developing aggregated data insights regarding our survey respondents and providing a client(s) with access to and use of the aggregated data insights.

Generally, disclosures of Personal Information by Zoom Media to a third party, except for disclosures of UIDs, are made pursuant to a written agreement between Zoom Media and the third party, which, among other things, limits use of the Personal Information.  Furthermore, the disclosure of Personal Information to the third parties is limited to the extent necessary to fulfill the purposes for which the Personal Information was collected.

We also share information about our user audience in aggregate or de-identified form, and nothing in this Policy restricts our use of aggregated or de-identified information in any way.

Please note that it may be necessary to disclose your Personal Information and your opt-out preference to third parties to allow them to remove or suppress your name from future solicitations. All of the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Except as stated above, or unless otherwise stated in this Policy or at the time of collection, our policy is that we will not sell, rent, share, or authorize any third party to use your email address or any information that personally identifies you without giving you prior notice.

4.            How do we use cookies and similar technologies? +

  1. Cookies, pixels, web beacons, and other tracking. The Services may use cookies, web beacons or pixels, Flash cookies, HTML5 local storage, and other similar technologies. We use these technologies to manage your access to the Services (e.g., so you don’t need to repeatedly enter your password), to recognize you and provide personalization, to measure traffic patterns, and to help us understand how our users use our site. You can change the settings on your browser to opt out of receiving cookies delivered by the Services, but you will not be able to access certain areas or features on the Services if your computer or device does not accept cookies from us.

Please note that Flash cookies operate differently from browser cookies, and cookie management tools available in a web browser will not remove flash cookies. To learn more about how to manage Flash cookies, you can visit the Adobe website and make changes at the Global Privacy Settings Panel.

Online advertisers may also use their own cookies to facilitate serving particular ads, such as tailoring ads to your interests, and to avoid sending you ads you’ve already seen. For more information about your choices relating to third party advertisers’ cookies, http://www.aboutads.info/choices/. Your access to our Services should not be affected if you choose not to receive third party cookies.

  1. Analytics. We may enter contracts with third-party service providers to collect non-personally identifiable data on our behalf and provide us with information, reports, and analysis about the usage, general location information, and browsing patterns of users of the Services. All of the data collected by these providers on our behalf is owned by us.

We do not have control over these service providers’ use of cookies or other tracking technologies or how they may be used.

  1. IP addresses. Our servers log Internet Protocol (IP) addresses, which identify the location of your computer on the Internet. We use this data to administer our networks and for troubleshooting. We also use this information, in aggregated form, to track our users’ access to the Services. We may share this information on an aggregated, anonymous basis with third parties.

5.            HOW DO WE USE E-MAIL OR SMS TEXTS TO COMMUNICATE WITH YOU? +

Zoom Media does not share, sell, rent, swap or authorize any third party to use your e-mail address for commercial purposes without your permission. If you believe that you have received an e-mail from us in error, please contact us.

We reserve the right to send you e-mail or SMS text messages relating to your membership in a Community, such as confirmations, notifications about changes to the Services, and/or to our Policy or Terms, and similar transactional communications. You are not able to opt out of receiving these messages.

From time to time we may send you e-mail or SMS text messages about products, services, and opportunities that we think may be interesting to you. If you do not wish to receive these communications, you can use the “unsubscribe” feature in each such email or message, or by contacting us.

You can choose to receive e-mail in either plain text or in HTML format. When we send you e-mail in HTML format, we may include a web beacon or pixel so that we can determine whether you have opened the e-mail. We will share this information only in aggregate form.

If you contact us by e-mail, we will use your e-mail address to respond to you. Please exercise caution in disclosing Personal Information, as email sent over the internet is not necessarily secure.

6.            WHAT ARE YOUR PERSONAL INFORMATION RIGHTS AND CHOICES? +

Applicable laws provide you with certain rights and choices with respect to your Personal Information as set out below. Please contact us if:

  • you wish to know how your Personal Information is collected, used or otherwise handled;
  • you wish to access, update, correct or request deletion of your Personal Information;
  • you wish to withdraw your consent to the processing of your Personal Information, or to restrict or object to our processing of your Personal Information;
  • you wish to ensure you have not been subjected to any automated decision making;
  • you wish to request a copy of your Personal Information that we process;
  • you have a question or complaint about this Policy or the manner in which your Personal Information is processed by us or our suppliers. We however hope that you will first contact us, so that we work with you to resolve any complaint or concern you might have; or
  • you want to report a privacy or security breach in relation to your Personal Information.

Feel free to contact us for any of the above reasons or if you have any questions or requests not covered above. We will take reasonable steps to verify your identity before responding to your requests. Please note that the rights above may not be an absolute right and may be subject to certain exceptions. Your rights may differ depending on where you live or could be subject to certain legal restrictions, as applicable laws may allow or require us to deny or partially deny your request.

7.            HOW CAN YOU OPT OUT OF DATA COLLECTION AND/OR USE? +

In addition to the general rights set out in Section 6, Community members may opt-out by: (i) following the instructions set forth in your membership account; (ii) clicking on the unsubscribe link contained in our electronic communications and following the instructions on the opt-out web page; or (iii) contacting us.

You may opt out of email communications, by clicking the unsubscribe link in any email you receive from us or contacting us.

8.            HOW DO WE PROTECT YOUR INFORMATION? +

Zoom Media has implemented commercially reasonable physical, technical, and administrative controls and procedures to protect the information that we collect. Unfortunately, no security measures are perfect and neither we nor our service providers can guarantee the security or confidentiality of any information you transmit to us.  As we work diligently to ensure that our practices meet or exceed legal and industry standard compliance, your cooperation is required to mitigate risks related to your Personal Information. If you become aware of any incident or breach in relation to your Personal Information, please contact us immediately.

9.            WHERE IS PERSONAL INFORMATION STORED AND/OR PROCESSED? +

The Personal Information collected in connection with this Policy is stored and/or processed on the servers of our suppliers, which may be located outside of your province/state and even outside of your home country of residence.  We protect your Personal Information in accordance with applicable laws, this Policy, and our contractual obligations wherever it is processed and whether it is held by us or by our suppliers. Accordingly, please note that, where permitted by law, we reserve the right to store and process your Personal Information outside of your province/state/country. Some of these countries may have data protection laws that are different from the laws of your province/state/country, and in some cases, may not be as protective.

By providing us with your Personal Information and continuing to access and/or use our Services, you consent to the transfer of your Personal Information outside of your province/state/country, including to the United States, in the event that such transfer is necessary for the purposes set out in this Policy. While this information is outside of your home jurisdiction, it is subject to the laws of the jurisdictions where it is stored and may need to be disclosed to governments, courts and law enforcement or regulatory authorities in that other jurisdiction, under laws of that jurisdiction.

10.          HOW LONG DO WE RETAIN YOUR INFORMATION? +

Unless specified otherwise in this Policy, we will delete Personal Information we have under our control in the following circumstances:

  • The purpose for which the Personal Information has been collected/obtained has been fulfilled, can no longer be achieved or the Personal Information is no longer necessary for the original purpose;
  • Consent has been withdrawn; or
  • Applicable laws, ethical requirements and/or contractual obligations do not permit the contemplated processing.

Where one of the above circumstances arise, your Personal Information will be destroyed, deleted, or made anonymous. After deleting your Personal Information, we may retain non-personally identifiable information and may continue to use it as permitted by this Policy and in accordance with applicable laws.

You may always request, as specified in the following section, that your Personal Information be deleted, but please note that we and our suppliers may be required to retain some of this information to comply with our legal obligations (in which case, we will comply with your request to delete the information only after we have fulfilled such obligations).

11.          HOW DO WE RESPOND TO “DO NOT TRACK”? +

Do Not Track (“DNT”) is a preference in your browser that you can set to notify websites that you visit that you do not want the websites to collect certain information about you. At present, there is no standard or agreement on how to respond to DNT signals that may be sent by web browsers. Accordingly, Zoom Media currently does not take any action in response to these signals. We may reassess how to respond to these signals if and when a final standard is established and accepted. In the meantime, and as described above, you can opt out of many advertisers’ use of cookies to tailor advertising to you by visiting http://www.aboutads.info/choices/. If you object to Zoom Media’s practice with regard to DNT signals, you may opt-out from participation or use of Zoom Media’s Services or Community.

12.          HOW DO WE PROTECT CHILDREN’S PRIVACY? +

Zoom Media cares about protecting children’s privacy. Our Services are not intended for minors, and they are not allowed to register. We do not knowingly collect or store any Personal Information about minors. Parents should tell their children not to send any information about themselves to us or disclose it in public discussion areas – including their name, email address, or mailing address. If we learn that we have collected any Personal Information from a minor without verification of parental consent, we will delete that information from our database as quickly as possible.

13.          YOUR CALIFORNIA PRIVACY RIGHTS +

California’s privacy law permits California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed their Personal Information, if any, for their direct marketing purposes in the prior calendar year, as well as the type of Personal Information disclosed to those third parties. If you are a California resident and would like to request this information or opt-out of the sharing of your Personal Information with third parties for marketing purposes, please submit your request in writing to privacy@zoommedia.com.

14.          HOW MAY WE CHANGE THIS POLICY? +

Zoom Media reserves the right to change this Policy at any time. Any such changes will be posted on this page. If we make a significant or material change in the way we use your Personal Information, the change will be posted on this page thirty (30) days prior to taking effect and registered users will be notified via e-mail. We may also post a notice on our Services.

16.          HOW DO WE MAKE A COMPLAINT? +

If you are not happy with our Personal Information handling practices or this Policy, you may have the right to lodge a complaint with the applicable data protection authority about our collection and use of your information.  If you are based in the EU, see ec.europa.eu for more guidance.  If you are based in the UK, you may contact the UK Information Commissioner’s Office. However, we hope you will contact us first so that we can address and resolve your complaint together.
